Factually, a police officer or victim of a crime will state the events that occurred that led them to believe a crime was committed. However, it is the judge who determines how many elements are in a crime, and whether or not the facts given would satisfy them. You cannot ask a witness or an officer what the elements are of the crime.

@InvisibleMajority This is exactly what I said would happen. Marc is wrong. The police aren't supposed to interpret the law, the judge is. Everything the judge told you is 100% correct. The police don't define how many elements are in a valid cause of action, the judge does. All the officer does is report what happened factually. If you had pressed him further, the judge would have gotten angry and you'd be in a terrible position, thanks to Marc's fake legal advice.

Went to trial tonight for doing 94km/h in a 50km/h zone. The crown put the cop on the stand and they went through an elaborate show of evidence, then I was given the option to cross examine. Asked "Did you file a valid cause of action against me" and he said "a traffic ticket? yes", then I asked "How many elements are required in a cause of action for it? to be considered valid" then the judge stepped in saying it was his position to interpret the law not the cops, but the cop couldn't answer

the question, I sort of backed down, but the judge went from friendly to defensive after that, but I really think if I'd pushed the point I could've had the cop impeached and his testimony stricken from the record. It was my first attempt at this, I was nervous, but next time I won't back down and I'll be asking how the cop knew he filed a valid cause of action when he doesn't even know what constitutes a valid cause of action. This the right approach Marc? (Canadian courts btw)

Your chances of running into a harmless water snake is a lot better than running into anything that could pose a serious threat. Good thing ur friend was ok. Spiders are cute. :) Not particularly fond of snakes but got few funny encounters in early days. Don't know if all water snakes are poisonous, was told to stay clear of any snake w/ triangular shape/spot/orange color on its head,or if whole body is colorful; usually lethal. For some type, once u got bitten like on ur arm/leg, even if u try to block the venom from flowing to ur heart, by tying ur arm/leg w/ rope/string, etc., u won't make it pass 3 steps. :o)
